Arbitration Clause
Model Arbitration Clause:
Ajman Commercial Conciliation and Arbitration Center would advise those wishing to have their disputes settled under the law of commercial conciliation and arbitration of the Center to include the following clause in their contracts:
“Any dispute arising from a contract or from executing, construing, cancelling, or terminating such contract or from validity or invalidity of such contract or being related thereto in any manner shall be disposed of through arbitration as per the rules and provisions stipulated under the law of the commercial conciliation and arbitration of Ajman Chamber of Commerce and Industry “System” by a single arbitrator /…. Arbitrators) to be appointed as per arbitration “system” of Ajman Chamber of Commerce and Industry.”
Separate Arbitration Agreement:
In the circumstances of a current dispute existing between / among the litigants, where such litigants have not agreed to solve it by arbitration, yet they may refer such dispute to arbitration under a new separate agreement. We would suggest the agreement to include the following:
“The litigants (please name the litigants and their respective capacities related to the subject of the contract, showing that they are capacitated and authorized to sign the same) to solve and settle the dispute related to (please mention the subject of the dispute and contract accurately and correctly) through arbitration as per the system and law of commercial conciliation and arbitration applicable at Ajman Chamber of Commerce and Industry “System” by (a single arbitrator / ..arbitrators) to be appointed as per the “System”.
The litigants are advised to mention the following points under the Model Arbitration Clause or under their agreement:
1- Specify number of arbitrators (single arbitrator) or (arbitration panel or authorize the center to specify the number of arbitrators and choose such arbitrators from the center-approved arbitrators list.
2- Specify the city of the arbitration (Ajman) and the venue of the arbitration procedures (Ajman Commercial Conciliation and Arbitration Center)
3- Specify the language of arbitration, such as (Arabic, or English)
